Anyone can bring a prosection under the Animal Welfare Act but the RSPCA are generally the organisation with the experience, expertise and resources to do so.

Last year at college we had our local WHW field officer come and do a talk on welfare laws. Anyone at all can do this. WHW do this, the man said that sometimes they get together to share resources with the rspca. But anyone who has the money to can start proceedings against someone.

I think the complaint about RSPCA stems from a series of complaints over 2 years about this situation and little appears to have been done. As I understand it RSPCA attended when Hope was pulled out of the ditch and Vikki acted to buy Hope only when she realised Hope was not going to be removed by RSPCA or nursed by owner If Vikki walked away at that stage the horse probably would not have survived.

Its all very well the RSPCA having to wait until they collate enough damning evidence but its lying dying in the field as we speak!! The Social Services have to wait until another Baby P happens before they act and then this repeat of Spindles Farm horror - when are the people at the top gonna stop worrying about losing their own jobs and listen to their conscience - if they have any that is

Hope you can use Fudge as evidence of the conditions the owner had left her in, before you rescued her. How is she doing now btw ? (PM me if you wish or start a new thread, as don't want to be accused of hi-jacking lol)

Poor wee Fudge must be wondering why all these people are being kind to her and when she might end up back in that freezing field..... Good thing is she won't ever end up there again

An SSPCA officer once tried to physically stop me taking photos of a horrible cruelty case. (the EHO has asked me to take pictures while they were on their way out) The SSPCA chap was really quite agressive in his efforts to stop me taking pics. Luckily there was a policeman with him. I told the SSPCA chap that the photos were for my own personal use should I wish to take out my own prosecution, the policemand agreed, that I was perfectly within my rights to take pics AND take out a private prosecution if I wanted........in the end the Council took him to court and got him banned from keeping horses. The SSPCA never used ANY of the evidence he was given. We bypassed him and gave it to the Proc Fisc directly!

Contacted the RSPCA many years ago about abuse and they did nothing - was the meat side of a local characters business (other was heavy horse drawn carriages on the sea front)so they never bothered him as he was a 'character' - good old john or whatever his name was. Thing is some of these old boys are nothing short of pikeys and very cruel!

Well just heard warrant issued for removal of horses by RSPCA officersand I think arrest of the owner as well............... confirmed by Dm reporter who was covering Hopes story. Think they may need the evidence f rom us about Fudge as well in order to prosecute the person concerned Emma (Madmare1) willahave more news when she gets back from the yard
