well im in the process of buying so i can tell u what ive done.
i've paid a deposit of £200 to keep her off sale. myself and the owner have written up a reciept to say if circumstances change and i wont b having her,she would keep 25% which i think is fair enough personally as someone else could just pick her up there and then.
i would DEF try more to get hold of her,only coz u really think this woman would miss the amount of money she gave u? thats if it was a substantial amount tho.
the only reason y i gave so much was because i wanted to prove to her i really am interested and im true to my word.

I had a similar thing happen, i sold a young mare and the people came and tried her and left a £50 cheque wich i put into my account. They had no transport and neither did i at that time. They diddnt turn up or try to call us, i rang 1471 when i got in. They called a few days later to say the transport let them down, and could they come that night? My daughter (11 at the time) told them i was out and she thought it would be ok. I got back and called her to say could she come another time as we have no power at the yard and i diddnt want to try and load a youg inexperienced horse in the dark. In the end she never came for her. Shame really, it would have have been a much nicer home than thre dodgey dealer i panicked and sold her to, i had put a deposit on another pony and couldnt have an extra one on the yard.
If i had known her address i would have sent the deposit back, because it was me who put them off collecting her that night. Sometimes when you have children your prioritys are different from the young free and single.
In your case i would contact her and ask her bluntly what her plans are concerning your horse, if shes still interested give her one more chance, if not see what her reason was for not turning up, if shes messing you about keep the deposit and sell the horse to someone nice.

I always say to people if they want to view a horse of mine, in the meantime if somebody makes me an offer i will have to accept! If they decide they like the horse & want me to hold it, i ask for ' non refundable deposit', which i write on the reciept. I will hold for the first week free of charge, then ask for a livery fee of £50p/w there after.

Aahh now this is a lady that had expressed an intrest in her a couple of days ago, not the lady that seems to be letting me down.
She sounds lovely bless her, would be really pleased if she came back to me about her.

If I had taken my horse off the market as requested by the potential buyer I would cash the deposit. That was the deal. A verbal contract is still binding. I would give the lass a chance and try and contact her as we all have problems making arrangement especially when third parties are involved and it is the festive go slow season.

If I were you I would leave a messege on her mobile stating time and date of call and tell her you will give her 24hrs to respond. If she does not get in touch then cash the postal order and re advertise yr lovely horse. If she contacts you again tell her you are not in a position to sell her the horse due to lack of contact on previous occasions and then wait for a reliable buyer to come along..after all if shes this lax at coming forward to contact you and get this sorted how will she be once she has the horse.... another unresponsible owner in our midst i foresee!! Put the cash in your pocket and put it down as a lesson learned in selling.... Really hope she goes to a lovely home tho as shes gorgeous....Good luck.

The postal order does have the post office stamp on it, doesn't it? Only if it doesn't, then it's void anyway. She does look an absolute stunner of a horse, with a lovely face!

Are you saying this women gave you a deposit before even viewing the horse? Maybe I read that wrong (probably! ) If that is the case what if she decided she didn't like her when she saw her? IMO a deposit is just that, something to 'hold' the item until you finish paying and collect. Hope you find somewhere nice for your mare.

I would cash the PO and take out enough for readvertising and put the rest aside in case she does come back,. thats of course if she doesnt get in touch with you in the next day or so. eileen x

I wouldn't keep the deposit unless it was put in writing that it was a non returnable deposit.You could get in trouble. If someone asks to leave a deposit, I either say no but I'll hold pony for x amount of time, then if they haven't bought, re-advertise. Or I state purchse to be completed by x date, or deposit is non returnable.This way i'm covered should people mess about.

I would be inclined to write to her and give her 7 days to advise you whether she still wishes to view the mare and that otherwise you will deem her to be no longer interested and use her holding deposit to cover the cost of re-advertising.....if you're a member of BHS or something else with a free legal helpline, then I would take advantage of that too though....just in case.
I wouldn't like to go ahead and assume she's not interested - I know that in business terms, that would probably be fine, but what if the woman is in hospital - I know I would feel pretty awful if I didn't give her another (albeit time-limited) opportunity.
