Hmmm not good at all... lol gin! I was going to suggest lots of people e-mailing them too! great minds eh? but it sounds like it's along the same lines as small print...if it only LOOKS like you've siad that, but doesn't actually say something like: Kelly Marks says beat your horse with a schooling whip...then is there much that can be done legally? I don't know, I'm only thinking, i know that mis understangs have happened a lot in the past and the people it has involved have come away none the better, because the companies can defend themseles. I've not got a copy so I can't have a look...the don't selll it here. It must be terribly upsetting though, because people will tkae it the wrong way. An apology and full spread in the next isuse sounds like the best way forward Am going to e-mail them though! xxx P.S I REALLY think you should come do a tour in Adelaide soon.........you still owe me a cuppa!!!

I just wonder how it happened? I thought that the Q&As in that issue had come from Your Horse Live and I suspect it might have been a genuine c*ck up - someone got you mixed up with someone else in the heat of the moment - rather than an attempt to defame/exploit you! Still annoying though obviously.
They need to print a large (ask for at least a half-page with pic, IH logo, and direct quote from you) and fulsome apology and I do think you want to ask for copy approval in future when advice is being given in your name, and also have this incorporated into your contract if you appear at live events like this.
It's not in any magazine's interest to make mistakes like this so I'm sure they'll be extremely contrite when you contact them. I'm certain that violence is not required, nor lawyers or even the PCC!

I know you think legal threat is a bit 'violent', Kelly, but to be honest this could have had serious implications for your business if someone hadn't emailed you. This is mis-representation in a major publication. I would certainly want a half page spread with a retraction in very big, bold letters.

The trouble with retractions is that they're usually printed 3 months later, 2 lines hidden on a back page somewhere and no one sees them.
I'd definitely be looking at libel, defamation of character and a big fat donation to a horsey charity plus large 2 page spread apology "Here's what Kelly Marks REALLY advises".

I've found out what happened! They taped the answers on a panel at Your Horse Live and I remember someone else giving this answer. The person responsible isn't in today and the Your Horse person was very apologetic and there will be a correction etc. I feel a bit sorry for the person that's made the boo boo as obviously it wasn't intentional (although still annoying!) A cheque to our IH Charity of the Year would be a nice gesture from them!

aha! thought so! I've known people to be sacked for less than this in the magazine industry, so let's hope you can resolve it amicably.
and seriously kelly, don't forget to put copy approval in your contract next time - they can't argue after this debacle and it will give you a very strong hand when dealing with them in future.

How dreadful! They probably chose that quote as it fits in with their usual line of advice - hit it, get a chifney, etc. I am always dissapointed when I read that magazine's advice columns.
