I take it TT you are voicing what the family / lawyer will say in their defense to that video ....... it being just a snapshot in time. If I were a lawyer I would not take on the defence of this case

Laura, I don't very often disagree with you, but in this case, and I wasn't there, I don't know the history, but that evidence on it's own does not mean cruelty full stop.
It means a man who has no idea about stock keeping. I would say that environmental health ought to haul him over the coals and have a very stong case in the video alone.
I was brought up by a pedantic legal mind. Everyone is entitled to justice and defence under the law. The law is an ass, I was taught to argue defense in cases which seemed cut and dried.
I am not defending cruelty, not one bit of it. But I would defend, or attempt to defend anyone against media hysteria.
Let's face it, I bet there are few, if any folk here, who were there at the time and 99% only have the media to draw upon to get their information.
Just hope one day it isn't you on the sharp end of an RSPCA knee jerk reaction.
If he is guilty I hope he swings from the highest yard arm in the land.

ooh dear no wally its is VERY rare we are not in complete agreement I have been involved in rescues and remember one very sad case where people not knowing the full story would have been up in arms...... pony a skeleton in a field a few yards from house when woman lived with fat dog. ( pone died day after we took it to the centre) However woman had dementia and field surrounded by trees and not visible unless you went past gate. Literally out of sight out of mind ... she forgot she had pone and unless she actually saw it she did not feed / water it. Dog however fed almost every time lady passed the empty food bowl ! Not cruelty and not neglect. re the video Agree its not absolute proof .... but still finding it difficult to imagine mitigating circumstances if I were in the meat trade and wanted to make money it would make sense to purchase half decent animals that just needed a little fattening up to make the best price ...... farmers don't go down the market and buy up the sickest looking animals, financially its would be ruination I can understand that its financially costly treating any sick animals ... but if they get sick and vet not called to treament then at the least its neglect ...... and I presume even the rspca needs evidence like that before the case is brought to court. ? I remember having a cat that looked like a neglect case .... he develope hyperthyroidism .... he could not physically eat enough to counteract what his body was using up. BUt if I had twenty cats looking like that Have to be b*****y unlucky and far to coincidental to be realistic well I guess we will all find out sooner or later.

Some of the responsibility has to lie with the people who have given him horses without proper checks, or just sent them on to sales without a consience. I just don't know what the answer is.

If I were a lawyer I would not take on the defence of this case Yes that is exactly what I am saying, unfortunately we all know of cases where a decent lawyer means rapists and murderers walk free. If these people are responsible for what they are accused of then I hope the Karma fairy visits them.

Just read this thread.The guy was buying horses at the end of january at the usual sales in wales.He is well known there.No one helped him load up his stock that day...My chap nearly bought a fjord off him for himself to use for logging work.He didnt buy him and there a fjord in the video.Hes been at the sales often since and now sells in a different name-using someone elses.He wasnt there this Thursday because of the court case.Shocking he carried on dealing all that time!He should not be allowed near a horse until the verdict is passed.Why they had rugs on??because they hide emaciated horses among other things.I will make my judgements on seeing this video and seeing an animal collapsed next to a water trough,but unable to drink it in my mind constitutes suffering. Cut off their limbs and hang the on the gateways to each large auction house to remind dealers how to look after their animals.I have to say most dealers are fine and do care-but some are total toerags
