I presume from what you have put about going to 'another yard where she keeps her new pony' that she no longer is at the yard you rent.
If I have read it right, I would forget about what items of tack she has of yours. Yes its bl**dy annoying and yes she has got away with it again, but you can chalk this one upto experience and be free of her and her daughter for good.
If you keep asking for your items back, you are the one keeping the contact up. If you let it go, there will be no contact. Ask yourself this, do you want to be rid of her and her daughter more than you want the remainder of your tack back?

Its the mother im having problems with. Still havent got the rest of the tack, and today if im right is friday. It would cost me about £80 to replace the items she still has. She is a bully, but she doesnt back down she just gets rude and abusive, and comes out with a load of rubbish. Never thought of CAB nice one!

Question for you............ did you set out initially when the girl started riding that if she stopped riding your pony that she would give all the tack back to you??
In theory she has committed theft - being curious how old is the girl, is she over 10??? Legal age of responsibility.
She has basically admitted the offence to you by saying that you're not having your remaining tack back. It definately worth contacting the police, they may try and bat it off saying its civil but at the end of the day, you are the owner of the property and she isn't, she knows that and wont give it back = theft............. definition - dihonesty appropriating property belonging to another with the intention of peminantly depriving the other of it. Fair enough she didn't initially come by the property dishonestly but when she refused to give it back her intention changed.
Have you got receipts or pictures of the tack to prove that it belongs to you?? Just thinking it would back up your complaint.

We said if it didnt work out just give us the tack and keys back, but in the end it was me who stopped the girl riding for the safety of all our horses!!! Yes ive got photos of the daughter on Misty. The mother is trying to be as big a pain as possible because i told them to get lost in September and she wanted another few weeks riding out of Misty. The girl is 10 and very tall for her age, she grew so much over the summer she really was a bit big on him, and although not fat shes not a skinny child either, so she might have been a little heavy for him, he is a 12.2 sec b, they were jumping him every day, another reason to stop them, the pony is in his early 20s and had a hard life, he started running out, i think it was just a bit too much for him. Who are we to know, her mother thinks no one exept her and her friend know anything about horses, funny that, who do they think has looked after him for the 10yrs they were not around!!

if you met her you would probably think she was ok, she can be quite charming when she wants, but do something she doesnt agree with and she turns into the most amazing spoiled brat!!

Crikey - these people have got a brass neck, haven't they!
As to whether it's a civil or criminal matter, I'm only a civil lawyer(bunny) but sounds to me as though it is in fact both (criminal liability often running alongside civil). If you were to try to involve the police, though, they would more than likely decline to pursue it further. That said, if you have a good local Bobby who might be prepared to call round at their house to make some discrete enquiries re. missing tack, you might sort it out quickly!
What's the value of the items? Advice above re small claims actions is bang on re. not recovering your costs even if you win (limit currently £5k). Online claims are cheaper to issue, and the court can serve documents for you.
Is it just the tack your after? Sounds like you could pursue her for the £50 too. Oral contracts are just as valid as written ones, but you're likely to get into a "he said/she said" row about exactly what was agreed.
All in all, I suspect the best advice, assuming she's not still coming round and making a pain out of herself, is to draw a line under it, replace the tack yourself and steer well clear of them. They sound like they've already caused you a lot of stress and upset. Litigation is (you've guessed it) stressful and can be upsetting. A 7 day letter (return items by x or we'll issue court proceedings) might be worth it, and it can be money well spent to get a solicitor to write it to carry more clout, but again do the costs justify it?

Thanks for that. It would probably cost me around £80 to replace the items she has, it might be that shes so short of cash shes using our stuff on her new pony. I just think shes deliberately trying to get me to go get the tack. She lives in a different area so i cant have a word with our local bobby. 30 yrs we've been letting other people ride our horses/ponies and never a problem, until her. Never again, they are for us from now on, appart from the yard owners daughter riding Misty, which is why i need his tack I'm just waiting for her to leave her dog in a hot car again, then we will see who has the last laugh. That was another reason i didn't like her.

I've had to sue a few people in the past and find the best thing is, down load the county court forms, fill them in, send them with a seven day letter saying you will sue if items, money not returned. If you send a letter without the forms people tend to think you are bluffing. Sorry but I wouldn't let her get away with it.

Trouble is although i know where she lives, Ive been there, i don't know her surname or the address, could that be a problem? She was at her pony's yard when i tried to talk to her last time. I'm wondering if i stay at the yard and refuse to go if she would call the Police...... Shes such a nasty bit of work I'm likely to get all my windows smashed.
